Understanding protection mechanisms in real estate brokerage in Quebec

The vast majority of real estate transactions go smoothly, attesting to the robustness and efficiency of the real estate brokerage system in Québec. However, when a problem does arise, there are a number of safeguards provided by the Real Estate Brokerage Act to protect consumers. Here is an overview of these key mechanisms:

Public assistance service

The Public Assistance Service is designed to help consumers in the event of problems with their real estate broker. If you feel your broker has breached professional rules, you can file a complaint or report a breach of ethics with this service, which will guide you through the complaint process.

The OACIQ syndic

The OACIQ syndic plays a crucial role in investigating allegations of breaches of the Real Estate Brokerage Act. If there is evidence of misconduct, the syndic may refer the matter to the Disciplinary Committee for possible sanction.

The Disciplinary Committee

The Disciplinary Committee evaluates cases of ethical misconduct committed by real estate brokers. If found guilty, the broker may be subject to disciplinary sanctions, helping to maintain the industry's high professional standards.

The ombudsman

The ombudsman acts independently and neutrally. This service can be called upon when traditional complaint handling mechanisms fail to resolve a dispute. The ombudsman provides an additional avenue of recourse for dissatisfied consumers.

Real Estate Brokerage Indemnity Fund (FICI)

The FICI protects consumers against fraud, dishonest transactions, or misappropriation of funds by a broker or agency. It provides an additional layer of financial security for consumers in real estate transactions.

The Fonds d'assurance responsabilité professionnelle du courtage immobilier du Québec (FARCIQ)

The FARCIQ provides professional liability coverage for real estate agencies and brokers in Quebec. It covers damages caused by unintentional fault, error or omission in the exercise of professional activities.

For more information on these mechanisms and how to proceed in the event of a problem, visit the website of the Organisme d’autorégulation du courtage immobilier du Québec (OACIQ).

These protection systems are essential to maintaining confidence in the Quebec real estate market and ensuring that consumers’ rights are always preserved.
